The AfD parliamentary group complained. She considers the increase in the MV protection fund from 700 million to 2.85 billion euros in December 2020 by the state parliament to be unconstitutional, as the court announced on Friday.

The AfD is of the opinion that 2.85 billion euros are not necessary to deal with the consequences of Corona in Mecklenburg-Western Pomerania and that other projects of the red-red state government that are not related to the pandemic should also be financed with the special fund. The largest opposition group sees the budget right of the state parliament violated. The MV protection fund will be inflated into a parallel budget and the debt brake laid down in the state constitution will be violated. The MV protection fund corresponds to more than a quarter of the annual budget of the federal state.

The state audit office, other opposition parties and the taxpayers' association are also critical of the multi-billion dollar endowment of the MV protection fund. The FDP expressed the view that the money should obviously be used to make up for past omissions and pent-up investments. Among other things, investments in digitization and in schools are paid for from the MV protection fund. The taxpayers' association also criticized that the money was used to finance projects that were not directly related to the pandemic.

The state constitutional court wants to negotiate orally in the organ dispute proceedings on Thursday. A decision by the judges will be announced at a later date.

In Hesse, the State Court of Justice had declared the federal state’s credit-financed special fund to deal with the Corona crisis to be unconstitutional in autumn 2021. After the judgment, Hesse wound up the special fund and anchored the Corona aid in the state budget.
