Saxony: Higher Regional Court lifts pre-trial detention because the proceedings are too long

Dresden (dpa/sn) - In 2021, the Higher Regional Court (OLG) in Dresden lifted the pre-trial detention of suspects in ten cases because the proceedings took too long or deadlines were not met. In a response to a small inquiry by the AfD parliamentary group in the state parliament published on Monday, the Ministry of Justice pointed out that regional and district courts can also lift pre-trial arrest warrants for this reason. Only the Higher Regional Court may order that detention be continued for more than six months. In 132 cases, the court ordered such continued detention.

AfD politician Volker Dringenberg criticized the fact that those released from custody also included suspects for crimes such as kidnapping by extortion, serious gang theft and crimes against the War Weapons Control Act. "Apparently, the state government takes it lightly when criminals have to be let loose again. Because for several years now, Saxony has been the nationwide leader on this inglorious topic. The overloading of the Saxon judiciary has been known for a long time," explained Dringenberg. The few additional judges and prosecutors who have been hired so far are just a drop in the ocean.
